Policy Problems of Freedom Criminal During the Covid-19 Pandemic Assimilation Pathway and Integration Rights

In Indonesia, the government implemented the release of prisoners through assimilation and integration programs starting march 31. Assimilation is the fostering of adult and child inmates by allowing them to live in a community setting. Meanwhile, integration is the release of inmates who have qualified for parole, parole, and leave before release. This exemption policy refers to the Regulation of the Minister of Law and Human Rights Number 10 of 2020 concerning Conditions for Providing Assimilation and Integration Rights for Prisoners and Children in the Context of Preventing and Combating the Spread of Covid-19. As of Tuesday, April 8, 2020, more than 35 thousand inmates were released. Meanwhile, when referring to World Prison Brief data, prisons in Indonesia are experiencing 104% overcapacity. This study aims to find out and examine the problems that occur from the prisoner release policy as a form of efforts to overcome COVID-19. The specifications in this study are descriptive analytical with normative types of legal research. This study uses secondary data obtained through literature studies as a data collection technique, then analyzed using qualitative analysis methods. The results showed that the government's efforts to overcome COVID-19 in prisons that have been "overcrowded" are to take a policy of releasing prisoners through assimilation and integration rights.
